Common mistakes when renovating in Alicante and how to avoid them

What warranty do renovations include?

The warranty for a renovation depends on the scope of the work, what is agreed in the contract, and the applicable regulations. It usually covers the correction of workmanship defects, labor and, where applicable, materials installed by the contractor for a specified period. To be able to enforce it, it is essential to have a contract and invoices detailing the conditions.

In Spain, when a renovation is considered building work, the LOE may apply, which sets liability periods for defects: 1 year for completion or finishing defects attributable to the builder, 3 years for defects affecting habitability, and 10 years for structural damage. For minor interior renovations that do not fall within that scope, coverage is governed mainly by what is agreed in the contract and by liability for defects under the Civil Code and consumer regulations.

The warranty must be in writing and state: the coverage period, the scope (what it covers and what it excludes), the procedure for notification and repair, response times, and required documentation. Materials usually have their own manufacturer’s warranty, independent of the workmanship, so it is advisable to be provided with data sheets, supporting documents, and the warranty terms for each product.

For the warranty to be effective, request a dated work completion acceptance document, keep invoices, quotes, and certificates, and notify any issue in writing within the deadlines. It is advisable for the contractor to offer after-sales service and for the contract to include an additional commercial warranty period on the workmanship.

When is an architect needed for a renovation?

In Spain, an architect is required for a renovation when the work is considered major works and requires a technical project: for example, if the structure is modified (load-bearing walls, beams, slabs), an opening in the façade or courtyard is created or altered, the building is extended (enclosures, lofts, mezzanines), or there is a change of use (from commercial premises to dwelling, storage room to bedroom). It is also usually mandatory for a full renovation that alters the general configuration of the property.

In these cases, the Town Hall will require a basic and execution project signed by an architect and site supervision during the works. By contrast, for minor works (finishes, tiling, installations without affecting the structure or façade, minor reconfigurations without touching load-bearing elements), an architect is not normally required and a minor works permit or prior notice is sufficient, depending on local regulations.

An architect is also essential when the renovation affects common elements of the community (roof, façade, courtyards, party walls), or if the building is listed or protected, as solutions must be justified in accordance with the Spanish Building Technical Code (CTE) and, where applicable, heritage regulations. Professional involvement makes it possible to certify stability, fire safety, health and hygiene, accessibility, and energy efficiency.

Other situations that often require an architect include works to improve accessibility (lift installation, ramps affecting the structure), the legalization of existing extensions, or renovations with a significant impact on compartmentation and evacuation. Criteria may vary by municipality, so it is essential to verify the required permit before starting the works.
